A Kogi State High Court sitting in Lokoja has granted the request for Hon. Muhammad Sani Gambo, the second runner up in the Kogi PDP State Congress held on 31 August, 2024 to be a Joined in the suit.
This followed his request for joinder and a notice of appeal, filed in the suit challenging the Chairmanship position of Kogi State People’s Democratic Party.
During its sitting today, the court presided over Justice Yahaya Adamu of the High Court 5, granted the suit for joinder and for notice of appeal by Hon. Muhammed Sani Gambo.
Gambo was the second runner up in the 31st August, 2024 PDP state Congress.
Recalled that Justice, Yahaya Adamu while delivering judgment in suit HC/Okp/8/2024 between
John Ojodale vs PDP and 1 other, ordered a fresh election within 45 days to fill the vacant seat of the Kogi State PDP Chairman, pointing out that Enemona Anyebe was not qualified to contest the Election.
The Court ordered in the contempt suit the arrest of Enemona Anyebe for contempt and for parading himself as Kogi PDP Chairman
Justice Yahaya Adamu in his ruling of 18th February, 2025, said Enemona Anyebe was not a contestant in that election, having been barred from contesting, consequently, ordered for his arrest for contempt.
In a swift reaction, Hon. Muhammad Sani Gambo, who said having finished as the second runner up, and dissatisfied with the declaration for a fresh election, sought to be a joinder, said since it was established that as at August 31, Enemona Anyebe was not a contestant in the election, ought to have been declared the winner.
He further added that in the contempt suit, there was no prayer for a fresh election as declared.
His request to be a Joinder and a motion on notice of appeal was consequently granted.
