Abeokuta – Justice Oluremi Oguntoyinbo of
a Federal High Court sitting in Abeokuta has dismissed a suit challenging the emergence of Governor Dapo Abiodun as the Ogun State Governorship Candidate of the All Progressives Congress (APC) in the coming 2023 elections.
The dismissed suit was filed by a former Governorship aspirant on the platform of APC, Mr Biyi Otegbeye.
The dismissal of the suit followed a motion for its discontinuation filed by Otegbeye’s counsel, Mr Wale Taiwo, SAN, and Professor Yemi Oke.
The court had earlier slated August 24 for the hearing of the preliminary objections and the originating summons.
However, when the matter was called, counsel to Otegbeye informed the court that they had filed a motion for discontinuation of the suit as directed by their client.
They said the plaintiff, Otegbeye, intended to seek remedy elsewhere.
The first defendant, the Independent National Electoral Commission (INEC), was represented by Damilola Akinduro, Kehinde Ogunwumiju, SAN, and Tunde Ahmed Adejumo represented APC, the second defendant while Professor Taiwo Osipitan represented Governor Dapo Abiodun, the third defendant.
Kehinde Ogunwumiju, SAN, who spoke on their behalf then informed the court that the defendants were not opposed to the motion for the discontinuation of the suit as filed by counsel to Otegbeye, the Plaintiff.
Ogunwumiju, however, urged the court to dismiss the suit with cost to the defendants instead of striking it out.
The Presiding Judge, Justice Oluremi Oguntoyinbo in his ruling agreed with the defendants’ counsel and consequently dismissed the suit.
The Judge also awarded N100,000 cost against Otegbeye, the Plaintiff. (vitalnewsngr.com)
